Definitions:

"VicHost" means Vic Host, The Provider

"The Client" means The Person or Entity who ordered our services

"Services" means the Product(s) or Service(s) that The Client has signed up to use. This includes, but is not limited to, the provisioning of Space on one of our servers, amd a connection to and from the Internet for web, email and FTP services to function at the level specified in the chosen service level and domain name registration. These Services are specified in the signup form and emails sent to The Client after signup and on our website. Detailed information on the Services can be found in the VicHost Client Area.

Terms Acceptance:

The Client signifies acceptance of The Terms as set out herein once they complete their order for Services by VicHost, and when that order is approved and complete.

VicHost's Promise:

VicHost accepts liability to provide Services to the extent provided in this agreement.

1. The Services provided will be uninterrupted and error free
2. The Services will meet your requirements, other than as expressly laid out in this agreement
3. The Services will not be subjected to external hacking attempts, viruses, worms, DOS attacks, or other persons gaining unauthorised access to Services or internal VicHost systems.

Suspension and Termination of Services:

VicHost reserves the right to suspend or terminate Services at any time without prior notification when:

1. The Client has been found to have violated these Terms
2. The Client has become insolvent or bankrupt
3. The Client has outstanding fees that are more than 14 days past due date

Accounts suspended will not be reactivated until such time as all outstanding fees and charges are paid in full.

VicHost accepts no responsability for any loss of data or finances resulting from suspended Services.

Data Management:

VicHost will not be responsable for the backing up of Data unless otherwise agreed upon between VicHost and The Client. The Client is provided with a Backup facility within cPanel to perform backups at any given time.

Website Hosting:

VicHost provides an additional service to website design clients at an extra monthly cost of $9.99 AUD. This service will enable your website to be hosted on the Internet by VicHost and will also allow The Client access to all aspects of the website, including source files via a user-friendly interface. The Client will be able to setup additional functions such as email accounts, databases, addon/parked domain and much more.

Payment of $9.99 AUD is due on or before the 1st day of each month. Failure to pay for this service with 10 days of the due date will result in account suspension until the hosting fees have been paid.

Website Design:

Before a design project begins, and upon agreement between the Client and VicHost, a 50% initial payment is required by VicHost to begin the work agreed upon. Once the initial 50% payment has been made, work will immediately begin. The initial payment covers any costs involved in setting up your account, such as domain name registration, hosting costs, labour, and any additional script fees endured during the work.

Once the project has been completed and both parties are satisfied, the final 50% of the design cost is then required before the website goes live. This final payment must be paid within 7 (seven) days. Failure to do so may result in the project being taken as abandoned and the project will then be dropped from our work schedule.

Please note that any finances exchanged during and after the design of the website is non refundable under any curcumstances.

Domain Registration:

VicHost, as part of it's services, offers affordable domain name registration and domain management. Domains obtained, as part of a special offer, remain the property of VicHost for the first 6 (six) months of service. After that date, The Client is permitted to have all contacts for that domain modified to their preferences.

If such situations arise, where The Client, for example, decides to leave VicHost before the 6-month period has passed, they will be given the option of purchasing the domain outright from VicHost and will receive the Authorisation Codes to transfer the domain to another Registrar. The Client may purchase the domain at that time for the cost of registration. For example, .com.au = $28.95. The Client will be responsible for any additional charges occuring from transfers.

If the client does not wish to purchase the domain, or has not responded to the VicHost offer of sale within a timeframe, the domain will be placed on Auction and sold to the highest bidder.

Website Design clients may obtain a free gTLD domain, such as .com, .net, .or or .info for free with website design services. Australian Business domains require a fee.

Changes To The Terms:

VicHost reserves the right to alter these Terms at the sole descretion of VicHost and without any prior notification. The Client is responsable to keep themselves up to date with and to abide by these Terms at all times.

The Laws:

The Client agrees to abide by all local State and Federal Laws pursuant to Services provided by VicHost in Australia.

The Client agrees that these terms are governed by the laws of Victoria, Australia, and agrees to the exclusive juristiction of the Courts of that State.
